These terms of use (“Terms”) govern your use of OFM Developer Hub which includes Application Programming Interfaces (‘APIs’), a sandbox environment, tools, content and intellectual property rights (“OFM Developer Hub”). You shall be deemed to have accepted to be legally bound by these Terms by virtue of your use of the OFM Developer Hub.
Proprietary Rights
This OFM Developer Hub is owned and operated by Payments Network Malaysia Sdn Bhd (Company Registration No. 200801035403 (836743-D)) (“PayNet”, “we”, “us”). All rights, title and interest in and to the OFM Developer Hub(including any documentation for the OFM Developer Hub) and any modification, improvements, derivative works or updates or upgrades shall remain exclusively with PayNet.
Test Environment
The sandbox within the OFM Developer Hub is a test environment which contains APIs for you to provide, develop and test solutions (“Ideas”) and interact with us or other participants. We will provide overall governance however, you are ultimately responsible for your Ideas and participation in the OFM Developer Sandbox.
Access Rights
To gain access to the OFM Sandbox, you need to register and have an account with the OFM. You are responsible for the accuracy, correctness and completeness of your registration information. You are also required to ensure that all information is kept up-to-date and any changes are reflected accurately to us throughout the term of your registration. Upon successful registration, you will be provided with access credential, passwords and other account information (“the Access Information”). The Access Information is and shall remain the property of PayNet and you are granted a non-transferable license to use the Access Information for the sole purpose of participating in the OFM Developer Hub.
Prohibitions
When accessing the OFM Developer Hub, or testing the APIs, you will not (i) modify, decompile, reproduce, distribute, prepare derivative works or reverse engineer any content in our OFM Developer Hub; (iii) use the trademarks, service marks or logos of PayNet in any way; (iv) gain unauthorised access or use to, or otherwise damage, impede, or disrupt our services or systems, including through fraudulent or disruptive means (v) use a bot, WebCrawler or any other automated process to extract data from the Developer Portal.
Compliance with Applicable Laws
Your use of the OFM Developer Hub including your Ideas must not violate any applicable laws and regulations, including copyright or trademark laws. You are responsible for making sure that your participation complies with all laws and regulations applicable to you.
Disclaimer
The OFM Developer Hub is provided on an “as is” basis without warranties of any kind, express or implied, including, but not limited to, warranties of title or implied warranties of accuracy, non-infringement, merchantability and fitness for a particular purpose, timeliness or completeness of any information. We do not warrant that our OFM Developer Hub environment will be uninterrupted or error free; nor do we make any warranty as to the results that may be obtained from use of the APIs, or as to the accuracy, reliability or content of any information, service, or merchandise provided through the Developer Portal. You expressly agree that your use of the OFM Developer Hub is at your sole risk.
No Liability
The above disclaimer applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorised access to, alteration of, or use of record, whether for breach of contract, negligence or other tortious behaviour, or under any other cause of action. You specifically acknowledge that PayNet shall not be liable for the defamatory, offensive or illegal conduct of other users or third parties and that the risk of injury from the foregoing rests entirely with you.
Changes and Termination
We may, in our sole discretion and without prior notice, terminate your access to the OFM Developer Hub for any reason, including when we believe you have not acted in accordance with these Terms. We can change, add or remove any part or feature of the APIs or the OFM Developer Hub, at our sole discretion. You should regularly check the Terms so you are aware of your rights and obligations. Your continued use of the OFM Developer Hubafter changes to the Terms constitutes your binding acceptance of the updated Terms.
